VV and New Builds: What the 10‑Year Rule Really Means

The widely discussed 10‑year restriction for new constructions applies exclusively to Vivienda Vacacional (VV) — the classic short‑term tourist rental model.

For buyers and owners, this means that new builds cannot be used for VV during their first ten years.

At the same time, this creates a second, often underestimated opportunity:

LAU Rental: Flexible, legally clear and usable from day one

Rental under LAU (Ley de Arrendamientos Urbanos) — especially for digital nomads, remote professionals and seasonal users — is becoming a stable and highly attractive investment category.

LAU means:

  • no tourist licence required

  • immediate usability from day one

  • predictable income through mid‑term tenants

  • legal clarity and strong social acceptance

For many new developments, LAU is the flexible, secure and immediately profitable alternative until VV use becomes possible.
